Refunds and Returns Policy for Realtydwar.com
This Refunds and Returns Policy (“Policy”) governs the terms under which refunds and cancellations are processed for services provided by Realtydwar, the operator of www.realtydwar.com and its associated mobile applications (“Site”). This Policy forms an integral part of the Terms and Conditions of Realtydwar.com and applies to all subscription-based services, paid services, and related offerings (“Services”) accessed through the Site. By using the Services, you (“User”, “You”) agree to be bound by this Policy. Realtydwar reserves the right to modify this Policy at any time, with changes effective immediately upon posting on the Site.
1. General Refund and Cancellation Terms
- Advance Payment: All payments for Services, including subscription fees, are required to be made on a 100% advance basis unless otherwise specified.
- Non-Refundable Activation Charges: For all Services, 50% of the total order value is considered non-refundable activation or administration charges. The remaining 50% may be eligible for a refund on a pro-rata basis, depending on the extent of Service usage and subject to Realtydwar’s sole discretion.
- Refund Processing Time: Approved refunds will be processed within 4 to 6 weeks from the date of submission of complete and accurate documentation, as required by Realtydwar. Refunds are subject to verification and are not guaranteed as a right.
- Disputes Over Invoiced Amounts: In case of disputes regarding invoiced amounts, Users must pay the full amount pending resolution. If Realtydwar determines the dispute is valid, any excess payment will be refunded without interest.
- Interest on Delayed Payments: Any delay in payment by the User will attract interest on the outstanding amount from the due date until full payment is received, as per Realtydwar’s discretion.
- Non-Refundable iOS Payments: All payments made through the Realtydwar iOS application are strictly non-refundable under any circumstances, including termination of Services or the Terms and Conditions.
- Forfeiture for Misrepresentation: If a User is found to have misrepresented their status (e.g., listing as an owner when they are a builder or agent), the listing may be deactivated without notice, and any payments made will be forfeited.
2. Subscription Fees and Cancellation
- Subscription Fees: Fees for Services are specified in the “My Subscriptions” section of the Site or as notified by Realtydwar. Liability for subscription fees begins on the Date of Commencement, as defined in the Terms and Conditions.
- Cancellation by Realtydwar: Realtydwar reserves the right to refuse, cancel, or withhold publication of any content or listing on the Site without prior notice. In such cases, applicable cancellation charges will apply as per this Policy.
- Non-Refundable Platinum Listings: Payments for Platinum Listing Packages are strictly non-refundable and non-cancellable, regardless of the payment method. For payments made via cheque or demand draft, cancellations are only accepted prior to payment realization.
3. Owner Services Refund Policy
- Non-Refundable Fees: Subscription fees for Owner Services (e.g., property listings by individual owners) are generally non-refundable.
- Partial Refund Eligibility: If the listed property is not linked to the purchased package, 50% of the order amount may be forfeited as activation/administration fees, with the remaining 50% potentially refundable on a pro-rata basis, subject to Realtydwar’s discretion.
- Processing Time: Refunds for Owner Services, if approved, will be processed within 6 to 8 weeks from the submission of complete documentation.
- Forfeiture for Misrepresentation: If a User listing a property as an owner is found to be a builder or agent, the listing will be deactivated, and the entire amount paid will be forfeited.
4. Money Back Policy
- Eligibility: Users dissatisfied with responses to listings under a Moneyback Package may initiate a refund request via the Feedback link on the Site, by emailing refunds@realtydwar.com, or by contacting Realtydwar’s customer care number.
- Conditions:
- At least one property must have been posted using the Moneyback Package to qualify for a refund.
- Realtydwar may first offer a free extension of the listing duration to evaluate further responses. Acceptance of this offer is at Realtydwar’s sole discretion.
- Refund requests must be initiated within the listing’s lifetime (i.e., within 60 days from the date of posting).
- Requests must reference the same Order ID and Customer Name provided at the time of booking.
- The order must be booked in the User’s name, as refunds will only be processed to the same account.
- Refund Deductions: For orders paid through online payment modes, refunds will be processed after deducting subscription charges, payment gateway fees, and applicable taxes.
- Processing Time: Approved refunds will be processed within 30 business days from the receipt and verification of all relevant documentation.
5. Tenant Verification Refund Policy
- Package Validity: The tenant verification package is valid for 90 days from the date of purchase. Users may contact Realtydwar within this period to avail the Services, using the contact details provided in the order confirmation email.
- Cancellation and Refund Eligibility:
- 100% Refund: Eligible if the cancellation request is made before sharing tenant details with Realtydwar and within 30 days from the date of purchase.
- No Refund: Requests made after tenant details are shared or after 30 days from the purchase date are not eligible for a refund.
- Exceptional Cases: In rare instances where the tenant verification service is not delivered within a reasonable timeframe or has clear deficiencies in quality, Realtydwar will assess the situation and may offer a refund, limited to the amount paid by the User, at its sole discretion.
6. Property Inspection Refund Policy
- Cancellation and Refund Eligibility:
- 100% Refund: Eligible for cancellations or rescheduling requests made at least 48 hours before the scheduled inspection date.
- 50% Refund: Eligible for cancellations or rescheduling requests made 24 to 48 hours before the inspection date (excluding the day of the service).
- No Refund: Cancellations made on the day of the scheduled inspection, after the inspection has occurred, or after the report has been shared are not eligible for a refund.
- Exceptional Cases: If the property inspection service is not fulfilled within a reasonable timeframe or exhibits clear quality deficiencies, Realtydwar will evaluate the case and may provide a refund, limited to the amount paid by the User, at its sole discretion.
7. Vastu Consultancy Refund Policy
- Cancellation and Refund Eligibility:
- 100% Refund: Eligible for cancellations made before sharing any documents or details (e.g., geolocation, property layout) with the service provider.
- 50% Refund: Eligible for cancellations made after sharing documents or details with the service provider.
- Exceptional Cases: In cases where the Vastu consultancy service is not delivered within a reasonable timeframe or has evident quality lapses, Realtydwar will assess the situation and may offer a refund, limited to the amount paid by the User, if deemed necessary.
8. General Provisions
- Discretionary Refunds: All refunds are at Realtydwar’s sole discretion and subject to verification. Realtydwar does not guarantee the accuracy or timeliness of refunds due to external factors, such as payment gateway limitations or banking processes.
- Set-Off Rights: Realtydwar reserves the right to set off any amounts paid by a User against outstanding dues owed under other agreements or services provided by Realtydwar.
- Non-Refundable Third-Party Services: Payments for third-party services (e.g., home loans, home interiors, site visits) facilitated through the Site are subject to the respective provider’s refund policies. Realtydwar is not responsible for processing or guaranteeing refunds for such services.
- Forfeiture Upon Termination: In the event of termination of Services or the User’s account (whether initiated by the User or Realtydwar), all fees paid are non-refundable, except as expressly stated in this Policy.
- Compliance with Laws: All refund processes comply with applicable Indian laws, including the Digital Personal Data Protection Act, 2023, and the Consumer Protection Act, 2019.
