General Terms & Conditions for Realtydwar.com

These General Terms & Conditions (“Terms”) form a legally binding agreement between you (“User”, “You”) and Realtydwar, the operator of the website www.realtydwar.com (“Site”) and its associated services (“Services”). These Terms govern your use of the Site, mobile applications, or any internet-connected device through which Realtydwar provides Services. By accessing or using the Site or Services, you agree to be bound by these Terms.

Realtydwar reserves the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site or Services after such changes constitutes your acceptance of the revised Terms. Realtydwar may also suspend or discontinue the Site or Services for maintenance, upgrades, or other purposes without prior notice.

I. Defined Terms

Unless otherwise specified, capitalized terms have the following meanings:

• Agreement: These Terms, including any completed application forms and attachments, executed in Patna.
• Realtydwar: The entity operating Realtydwar.com, incorporated under the Companies Act, 2013, with its registered office in patna, India.
• Date of Commencement: The date you accept these Terms or begin using the Services.
• Date of Termination: The date specified in any termination notice or the end of subscribed Services.
• Site: The website www.realtydwar.com and its mobile applications.
• My Subscriptions: The section of the Site detailing Services availed by the User.
• Registration Data: Information provided by the User during registration, including name, contact details, and address.
• User: Any individual or entity using the Site or Services, including subscribers, advertisers, or visitors.
• Confidential Information: Non-public, proprietary information disclosed by Realtydwar in connection with the Services.

Words importing the singular include the plural, masculine includes feminine, and references to persons include both individuals and entities.

II. Services

Realtydwar provides internet-based Services, including but not limited to:

• Posting property listings for sale, rent, or lease.
• Searching for properties on the Site.
• Posting online advertisements.
• Sending promotional messages via email or SMS.
• Other Services as described on the Site.

Services are subject to subscription fees, payment terms, and applicable policies as outlined on the Site.

III. Eligibility

You represent and warrant that you are at least 18 years old, legally competent to enter into contracts, and capable of complying with these Terms. Minors may use the Services only under the supervision of a parent or legal guardian via their registered account. You agree to provide accurate and complete Registration Data.

IV. Subscription Fees

Subscription Fees for Services are specified in the “My Subscriptions” section or as notified by Realtydwar. Fees are payable from the Date of Commencement. Users accessing listings for purchase purposes may be exempt from fees unless otherwise notified.

V. Payment & Refund Policy

• 50% of the total order value is considered activation/administration charges, with the remaining 50% potentially refundable on a pro-rata basis upon cancellation, subject to Realtydwar’s discretion.
• Refunds, if approved, will be processed within 4-6 weeks of receiving complete documentation.
• Payments for Services via the iOS application are non-refundable.
• For Owner Services, subscription fees are non-refundable unless the property is not linked to the purchased package, in which case 50% may be refunded on a pro-rata basis, processed within 6-8 weeks.
• If a User is found to be a Builder/Agent instead of an Owner, the listing may be deactivated, and the amount paid forfeited.

VI. Charge Back Policy

• Payments for Services are made on a 100% advance basis and are generally non-refundable.
• Refunds, if any, are at Realtydwar’s sole discretion.
• Realtydwar may set off amounts paid by a User against any dues owed under other agreements.
• Realtydwar does not guarantee the timeliness or accuracy of refunds due to external system limitations.

VII. Cancellation

Realtydwar reserves the right to refuse, cancel, or withhold content publication without notice. Cancellation charges may apply as per Realtydwar’s Cancellation and Refund Policy. Payments for Platinum Listing Packages are non-refundable and non-cancellable.

VIII. Security

• Transactions on the Site are encrypted and secure. Payment details are handled by authorized gateways and not stored by Realtydwar.
• Users must safeguard their login credentials and report any loss or theft immediately to Realtydwar.
• Unauthorized use of automated software for data extraction is prohibited.
• Realtydwar is not liable for fraudulent transactions or unauthorized deductions.

IX. User Obligations and Representations

• Provide accurate and complete Registration Data, subject to verification by Realtydwar.
• Obtain necessary licenses, permits, and intellectual property rights for using the Services.
• Comply with Realtydwar’s instructions and applicable laws.
• Maintain confidentiality of login credentials and notify Realtydwar of any security breaches.
• Ensure all submitted data is accurate and free from third-party claims. Users indemnify Realtydwar against any disputes arising from submitted data.

X. Prohibited Actions

Users are prohibited from:

• Allowing unauthorized access to Services.
• Posting unlawful, defamatory, or misleading content.
• Impersonating others or disclosing confidential information without authorization.
• Uploading viruses, malware, or engaging in unauthorized access.
• Sharing false or deceptive information or engaging in spamming activities.

Violations may result in account suspension, deactivation, or forfeiture of subscription amounts.

XI. Intellectual Property Rights and Data Usage

• All intellectual property on the Site and Services belongs to Realtydwar.
• User-contributed content vests in Realtydwar, and unauthorized reproduction constitutes infringement.
• Users are granted a limited, non-transferable license to use the Services as per these Terms.
• Realtydwar may use User data for operational, analytical, or marketing purposes, subject to the Privacy Policy.
• Users consent to receiving communications from Realtydwar or its partners.

XII. Confidentiality

Users agree to maintain the confidentiality of non-public information received from Realtydwar and not disclose it without prior written consent, except as required by law. This obligation survives termination of the Agreement.

XIII. Amendments

Realtydwar may amend these Terms at any time, with changes effective upon posting. Continued use of the Services constitutes acceptance of the revised Terms.

XIV. Services Modification, Discontinuation, and Maintenance

Realtydwar may modify, suspend, or discontinue Services without notice. No refunds or adjustments will be provided for interruptions due to maintenance or discontinuation unless expressly agreed by Realtydwar.

XV. Third-Party Links and Resources

• The Site may link to third-party content, which Realtydwar does not control or endorse.
• Users access third-party websites or services at their own risk.
• Realtydwar is not liable for any loss or damage arising from third-party content or services.

XVI. Termination and Suspension

• Users may request suspension or termination in writing, subject to Realtydwar’s discretion.
• Realtydwar may terminate access immediately for fraud, misrepresentation, or other prejudicial acts.
• Fees paid are non-refundable upon termination.
• Provisions such as confidentiality and dispute resolution survive termination.

XVII. Money Back Policy

• Users dissatisfied with responses to listings under a Moneyback Package may request a refund via the Site’s feedback mechanism.
• A free extension may be offered before processing a refund, subject to Realtydwar’s discretion.
• Refund requests must be made within 60 days of posting and will be processed within 30 business days.

XVIII. Disclaimer

• Realtydwar does not guarantee uninterrupted, secure, or error-free Services, or the accuracy of information provided.
• Users use the Site and Services at their own risk and must verify third-party information independently.
• Realtydwar is an intermediary under the Information Technology Act, 2000, and does not endorse user content.

XIX. Limitation of Liability

Realtydwar is not liable for any direct, indirect, or consequential damages arising from:

• Use or inability to use the Services.
• Unauthorized access to User data.
• Third-party conduct or content. Total liability is limited to the fees paid by the User in the two months prior to the claim.

XX. Indemnity

Users agree to indemnify Realtydwar against claims arising from their use of the Services, including content that infringes intellectual property or violates laws.

XXI. Governing Law and Jurisdiction

These Terms are governed by Indian law, with exclusive jurisdiction in the courts of New Delhi. Any claims must be filed within 30 days of arising.

XXII. Privacy Policy

Realtydwar respects User privacy and collects data as per its Privacy Policy, available on the Site. Users consent to data use for property-related purposes.

XXIII. RERA Disclaimer

• Users listing properties must comply with the Real Estate (Regulation and Development) Act, 2016.
• Realtydwar does not verify RERA compliance or the authenticity of listings.
• Users are responsible for verifying project details independently.

XXIV. Grievance Redressal

Complaints regarding content or breaches of these Terms should be reported to Realtydwar’s Grievance Officer at grievance@realtydwar.com.
